Department of Health and Human Services, under the Common Rule (45 CFR 46.102(l)), research involving only de-identified data does not constitute human subjects research, as there is no intervention or interaction with living individuals and no access to identifiable private information. Specifically, our data met the "safe harbor" standard of de-identification outlined in HIPAA Privacy Rule § 164.514(b)(2), with all 18 types of identifying information removed/excluded [34].
